On August 17, 2010, my daughter Marine, who had just suffered a painful separation from her partner, let herself be tempted by advertising clairvoyance services by SMS to the number 71030 and was unable to cope. On January 2, 2011, having noticed what was happening, I blocked the cell phone to stop the flow of text messages because we saw no other way. The result is impressive: 4,600 SMS exchanged for an amount invoiced by Bouygues of €2,623 of which €1,011 was paid, the direct debits for the months of October, November and December having been put in opposition to the Bank.
To my first email to the company CELLFISH MEDIA France, they replied that they could not be held responsible; Bouygues, according to this company, must verify the operation of this paid SMS service.
… first of all I contacted this operator who informed me that he was not concerned by what his customers did, but thanks to his customer service I ended up understanding what was happening and how to get out of it, which brings me to you the company CELLFISH MEDIA France which he considers solely responsible.
To understand the process, I tested the 71030 service twice and I noticed that there is no clearly expressed acceptance and that there was no information that could give the consumer free choice, namely that:
1- Each exchange of text messages is chargeable,
2-Exchanges are not limited and the customer may be subject to insistent reminders,
3- No information to contact the company CELLFISH MEDIA France and even less to put an end to clairvoyance text message exchanges
4- The price is not clearly indicated except on a few SMS messages, but to obtain it you have to write the word “live” without further details….
5-Consumers who are not aware of how SMS+ works are systematically “trapped”. This is all the more shocking since this type of product mainly attracts a psychologically weakened audience.
I was able to learn about the practices of so-called CELLFISH MEDIA clairvoyants who abuse vulnerable customers by manipulating them and making them believe that they are capable of helping them for cold hard cash.
I therefore believe that my daughter was harmed by the practices of this company specializing in large-scale fraud.
I ordered the latter to reimburse the sums fraudulently collected under the cover of clairvoyance which amounts to mental manipulation and charlatanism.
It is obvious that we would prefer an amicable arrangement but will not fail to use all legal means to assert our rights.
