A clairvoyant rejected and condemned

The summary judge of the Marseille High Court has just rendered his decision dated June 30, 2016, agreeing with the INAD: “Whereas, on the assessment of the alleged disturbance, the reading of the incriminated messages shows that people who have used the applicant’s service have not been satisfied, which they each express in their own way within the framework of freedom of expression that the judge of the summary proceedings, guardian of individual freedoms , cannot hinder. That in this case the messages within the framework of this freedom cannot be prevented, not involving excess to the point of characterizing a manifestly illicit disturbance, the informed and reasonable reader of such messages being able to distinguish things…let us order Mrs. Danaé ROUX to pay to the defendant association (INAD) compensation of €800 under article 700 of the CPC- Let us leave the costs to be borne by Mrs. Danae ROUX. »

In this case, the INAD association was assisted by Maître Julien AYOUN, lawyer at the Marseille Bar.
