On October 25, 2011 and the following days, based on countless testimonies recounting the more than doubtful practices of the WENGO company in terms of clairvoyance, the INAD published on its website and on its Facebook page several articles entitled: “WENGO: Scam expert’’?, Professional secrecy “Violated” …
Seized of an emergency request by the self-proclaimed company “N°1 of the council of experts” (?), the President of the Paris Commercial Court ordered the INAD to delete the said articles, without even having to ask it to justify its assertions.
But, sure of its rights, the Institute, assisted by Maître Gordon Fairbairn, associate lawyer at the firm Flécher Poujade Panon Fairbairn, had put in place a procedure to ensure respect for the principle of adversarial proceedings.
At the end of this procedure, the Paris Court of Appeal has just handed down two judgments dated November 29 (Facebook support) and December 4 (INAD website support hosted by Amazon), agreeing in all respects with INAD by allowing it to put its articles back online, and by ordering the company WENGO to pay it the cumulative sum of €4,500 for legal costs.
